14 поправка

Понял каким образом коллективный Трамп хочет обойти в суде 14 поправку, которая гласит:

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Казалось бы, всё ясно и ловить нечего. All persons - баста. А идея, оказывается, такая:

"Ample historical evidence shows that the children of non-resident aliens are subject to foreign powers—and, thus, are not subject to the jurisdiction of the United States and are not constitutionally entitled to birthright citizenship"

Несмотря на TDS, я на самом деле согласен, что 14 поправку надо пересмотреть и детей нелегалов оттуда вычеркнуть. Но я не вижу как такой аргумент может пройти через суд. Т.е. понятно, что Томас и Алито проголосуют за что угодно, но остальные - вряд ли. Предсказываю 2:7.

, вроде бы получается тавтология — получивший гражданство является гражданином. Очевидно, суть в пункте "and of the State wherein they reside", т.е. того, кому федеральное правительство дало гражданства, штат должен признавать своим гражданином.
